Terms of Service

The rules for using Roam, what our information does and does not promise, and how responsibility is shared between us.

1. This agreement

These terms are between you and Roam UG (“Roam”, “we”, “us”). They govern your use of roam.ug, the Ask Roam assistant, and the Roam WhatsApp channel (together, the “Service”).

By using the Service you accept these terms. If you do not accept them, please do not use the Service. Our Privacy Policy and Cookie and tracking notice form part of these terms.

Roam UG is registered in Uganda under registration number 80034479407189. Our full controller details are set out in the Privacy Policy.

2. What Roam is, and what it is not

Roam is an independent local guide. We collect information about places and services in Kasese through our own fieldwork, record when each record was last verified, and answer questions using those records.

Roam is not:

  • A booking or reservation agent. We do not make reservations, take payments, or hold money on your behalf. Any booking is made directly between you and the business.
  • An agent or representative of the businesses we list. Listing a business is not an endorsement, a recommendation of its safety or quality, or a warranty about it.
  • The organiser of the Rwenzori Marathon, or connected to it. Roam is an independent companion for the local trip around the event. Registration, race rules, routes and official announcements are the responsibility of the official organiser, and you should rely on the official race website for those.
  • A provider of professional advice. Roam does not give medical, legal, financial, safety or travel-risk advice.

3. Accuracy of information, and your responsibility to confirm

We work hard to publish information that is real and locally checked, and every listing shows the date it was last verified. Even so, conditions in Kasese change: prices move, opening hours vary, phone numbers change, roads and transport conditions differ by season, and a place can close.

You must confirm current prices, availability, opening hours and safety directly with the business before you travel, rely on the information, or pay any money. The verification date shown on a listing tells you when we last checked, not that the information is correct today.

Where Roam cannot find a confident, verified answer it will say so rather than guess. An absence of information is not a statement that something does not exist.

4. Answers from the assistant

Ask Roam produces answers by matching your question to our own verified records. Answers may be incomplete, may miss a place we have not yet recorded, and may not reflect a very recent change. Treat an answer as a helpful starting point to be confirmed, not as a guarantee.

5. Dealing with businesses and third parties

Any contract, booking, purchase, transport arrangement or visit you make with a business you found through Roam is solely between you and that business. We are not a party to it.

We are not responsible for the acts, omissions, goods, services, pricing, safety or conduct of any listed business, nor for the content of external websites we link to, including map and directions services and the official marathon website.

6. Acceptable use

When using the Service you agree not to:

  • use it for any unlawful purpose, or to harass, defraud or endanger anyone;
  • submit content that is unlawful, abusive, defamatory, or infringes someone else’s rights;
  • scrape, harvest or bulk-extract our listings, or use automated means to place unreasonable load on the Service;
  • use contact details published in the directory to send unsolicited marketing to listed businesses;
  • attempt to gain unauthorised access to the admin workspace, our database or any account;
  • interfere with, disrupt or attempt to circumvent security or rate-limiting measures;
  • misrepresent Roam as the organiser of, or as officially affiliated with, the Rwenzori Marathon.

We may restrict or withdraw access to the Service where we reasonably believe these rules have been broken.

7. The WhatsApp channel

Where Roam is reachable on WhatsApp, your use of WhatsApp is also governed by WhatsApp’s own terms and privacy policy. Messages you send us are received and stored so we can reply, as described in the Privacy Policy. Do not send us payment details, identity documents or other sensitive information over WhatsApp.

8. Questions and messages you send

You keep ownership of what you send us. By sending a question, a contact message or feedback, you allow us to use it to operate and improve the Service, including identifying gaps in our coverage so we can verify new information. Stored question text has email addresses and long digit sequences removed automatically. Please do not include personal or sensitive details in your questions.

9. Our content and brand

The Roam name and mark, the design of the Service, and the compilation, structure and presentation of our directory belong to Roam UG and are protected by law. You may use the Service for your own personal travel planning. You may not copy, republish or commercially reuse substantial parts of our directory without our written permission.

10. Availability

We aim to keep the Service available, but we provide it “as is” and “as available”. We do not warrant that it will be uninterrupted, error-free, or that any particular information will be present or current. We may change, suspend or withdraw any part of the Service, including the WhatsApp channel, at any time.

11. Limitation of liability

Nothing in these terms limits liability that cannot lawfully be limited, including liability for death or personal injury caused by our negligence, or for fraud.

Subject to that, to the fullest extent permitted by Ugandan law:

  • we are not liable for loss or damage arising from your reliance on information published through the Service, including prices, availability, opening hours or transport conditions that have changed since we verified them;
  • we are not liable for the acts or omissions of any business or third party you find through the Service;
  • we are not liable for indirect or consequential loss, or for lost profits, lost bookings or wasted expenditure;
  • our total liability arising out of or in connection with the Service is limited to UGX 500,000.

12. Your responsibility to us

You agree to reimburse us for reasonable losses and costs we suffer arising from your misuse of the Service or your breach of these terms, including any claim brought by a third party as a result.

13. Governing law and disputes

These terms are governed by the laws of the Republic of Uganda, and the courts of Uganda have exclusive jurisdiction over any dispute arising from them. If you are a consumer resident elsewhere, this does not deprive you of the protection of mandatory consumer law in your country. Before starting proceedings, please contact us so we can try to resolve the matter.

14. Changes to these terms

We may update these terms as the Service develops. The effective and last-updated dates are shown at the top of this page, and continuing to use the Service after a change means you accept the updated terms.
